Terms of sale
1. Delivery and payment terms:1.1 These delivery and payment terms form an inseparable part of all offers and agreements regarding the delivery and benefits of the Seller, both in current and future trade relations.
1.2 These conditions apply to all offers and contracts regarding the sale and delivery of machinery and equipment by SERVO.
1.3. Derogation from the Terms of Sale is possible only with the written permission of SERVO. In case of simultaneous occurrence of two written confirmations containing divergent content or provisions, the Seller's confirmation is binding.
2. Offer:
2.1 The commercial information provided on the website www.servo-maszyny.pl is not binding for SERVO and does not constitute an offer within the meaning of the Commercial Code.
2.2. The Seller's offers remain non-binding until the order is finally confirmed; in the meantime, the right to sell the goods to another buyer is reserved. The seller is entitled to accept the offer in writing within 14 days of its receipt. The order is considered accepted at the moment of payment of the deposit on the machine or device by the Buyer.
2.3 Arrangements and additional arrangements require written confirmation for their validity.
2.4. Delivery dates are valid for the reservation of correct and timely own deliveries, unless incorrect or delayed own deliveries were caused by the Seller or the Seller confirmed binding delivery dates in writing. If the deadlines can not be met for reasons beyond the control of the Seller, it is excluded to withdraw from the contract due to delay.
3. Prices:
3.1. The prices included in the offer are net prices for the machine after the service.
3.2. Prices quoted do not include VAT. The prices are given in Polish zloty (PLN) or euro (EUR).
3.3 SERVO reserves the right to change prices and products before placing an order by the buyer.
3.4 The sale price is valid on the terms: INCOTERMS 2010.
4. Payments and process:
4.1 After accepting the offer by the Buyer, a pro forma invoice is issued.
4.2 After payment of the deposit to the machine within 3 working days, the service starts.
4.3. The buyer is informed about the completion of the service.
4.4 Then a VAT invoice is issued.
4.5 After paying 100% of the price, the machine is ready for pick up or shipment.
Attention!!! We only release the machines after settling the full invoice amount.
5. Delivery of devices:
5.1 The equipment is delivered based on the International Rules of Trade: INCOTERMS 2010 on the terms: FCA

"The seller bears the costs of transport, loading and insurance until the goods are delivered to the first carrier, indicated by the buyer, in the designated place. Goods are considered delivered at the time of loading by the carrier, at this point the risk of damage or loss of goods to the buyer is transferred. "
6. Warranty
6.1. Warranty for used machines and devices after the service includes 14 calendar days from the date of delivery to the Buyer.
6.2 The warranty for new machines and devices covers a period of 12 months from the date of commissioning the device and not longer than 13 months from the date of sale.
6.3 The warranty for new machines and devices as well as used machines and devices covers only the area of Poland. All repairs outside Poland are payable and the repair conditions are set individually. The warranty covers parts or components of machines that have failed without user's fault. As part of the warranty, repair can be made after delivery of the device to the Seller's warehouse.
6.4 The list of parts listed in the machine or device after the service will be included in the WZ or CMR document.
6.5 The warranty for used machines and devices after the service includes only mechanical and electrical components. It does not include electronic components such as: controller, limit switches, etc.
6.6. Defects caused by improper use of the machine will not be taken into consideration, possible repair and service in such a case will take place at the expense of the purchaser.
6.7 Service of the machine in the above-mentioned cases is payable.
6.8 In the event of a major fault, the machine will be repaired at SERVO's headquarters, hereinafter referred to as the Guarantor, in Białobrzegi 95A.
6.9. The costs of transports before and after the warranty cover the Buyer.
6.10. Warranty repair covers only defects caused by the causes inherent in the device sold.
6.11 The warranty repair shall be performed in the shortest possible time, not exceeding 30 days from the date of acceptance of the device for service. If it is necessary to import spare parts, the repair period may be extended. After the repair has been carried out, the warranty period continues to be extended by the repair time.
6.12 The Guarantor undertakes to remove free from defects discovered during the guarantee period, by repairing or replacing it with a device free from defects. The Guarantor decides about the method of removing the defect.
Damaged and replaced parts or devices become the property of the Guarantor.
6.13 The Guarantor may refuse to perform the warranty repair or completely waive the warranty in the case of incomplete repair, unauthorized repairs or maintenance, structural changes, use of the device for purposes not intended for the purpose and re-configuration or expansion of the device by a person not authorized by the Guarantor.
7. Complaints
7.1 Defects of devices after the service should in any case be advertised immediately after their detection, at the latest within 14 calendar days from the date of release of the goods from the warehouse to the Buyer.
7.2. The Buyer may only advertise the parts or scope of the service listed in the "Agreements with the Customer"
7.3 If the Buyer submits a complaint after 14 days from the date of release of the goods from the warehouse, the service of machines or devices is payable.
7.4 The right to return by the Buyer after 14 days from the date of release from the warehouse is excluded.
8. Other provisions.
8.1 Non-compliance of one or more of these provisions with the Act or their legal ineffectiveness resulting from another reason does not affect the validity of the remaining provisions of the contract. In this case, the parties to the contract undertake to adopt a substitute regulation, in the best possible manner, which reflects the economic purpose of the ineffective provision.
8.2 The District Court in Zamość is the competent court to settle disputes. By placing an order, the Ordering Party accepts the above Regulations.
